Terms of Service

1. Your account

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account.

2. Acceptable use

You agree not to use Simply Streamers to generate overlays that infringe copyright, that include hateful or harassing content, or that violate any platform's terms (Twitch, Kick, etc.). Generated overlays are for your own broadcast use.

3. Credits and one-time purchases

A new account is given three free generation credits, once, the first time it opens the studio. The offer applies to accounts created on or after 16 August 2026 and may be withdrawn or changed for future sign-ups at any time. Additional credits may be purchased in top-up packs. Credits are spent when an overlay is generated: one credit per overlay plus two for each image it uses. If a generation fails or uses fewer images than estimated, the unused credits are returned to your balance. Gallery overlays are one-time purchases of a single item and stay available on your account. We may adjust credit and item pricing, and will give notice in-app before a change takes effect.

4. Gallery download limits

Buying a single gallery overlay includes 10 downloads of that overlay. Any paid plan includes 20 downloads of each overlay, and every download of the same overlay after that costs 1 credit from your balance. Counts are kept per overlay, they do not reset or expire, and a file you have already downloaded stays yours to keep and use under these terms. These limits exist so that a purchase cannot be turned into a bulk redistribution channel, and the allowance is shown on the gallery page before you buy. If you reach a limit and believe it is in error, contact support and we will sort it out.

5. Subscriptions and automatic renewal

Starter, Pro and Studio are monthly subscriptions. When you subscribe you are agreeing to a recurring charge: your card is billed the plan price on the day you subscribe and then automatically on the same day each month, at the price shown at checkout, until you cancel. There is no fixed term and no cancellation fee. Your monthly credits are added to your balance on each successful renewal.

You can cancel at any time from the billing panel in the studio, or by contacting us through the support page and asking us to cancel it for you. Cancelling stops all future charges immediately and there is no cancellation fee.

Cancelling forfeits your remaining credits. Credits granted with a subscription belong to that subscription: when you cancel, your plan ends and any unused credit balance is removed from your account and set to zero. Forfeited credits cannot be restored, including if you subscribe again later, so spend them before you cancel if you want to use them. This does not affect overlays you have already generated or gallery overlays you have bought outright, which stay on your account. It also does not affect any refund or cancellation right you have under the consumer law that applies where you live, as described in section 6.

6. Refunds

If something does not work and we cannot fix it, contact us and we will refund you. Beyond that, subscription payments and one-time purchases are generally non-refundable once the billing period has started or the item has been downloaded, because what you are buying is delivered immediately. Nothing here limits any refund or cancellation right you have under the consumer law that applies where you live, including statutory rights to cancel a distance purchase, and those rights always take precedence over this section. When we refund or you cancel an order, the matching plan, credits or gallery item are removed from your account.

7. Your content

You retain ownership of the prompts you submit and the overlays generated from them. You grant us a limited license to host and serve those overlays as needed to operate the service. By submitting prompts and editing overlays, you agree that we may save that input to learn your preferences and improve the default overlays we suggest to you, as described in our Privacy Policy.

8. Service availability

We strive for reliability but provide the service "as is" without guarantee of uptime, generation quality, or uninterrupted access. We may modify or discontinue features with notice.

9. Limitation of liability

To the maximum extent permitted by law, Overclock Software LLC is not liable for indirect, incidental, or consequential damages arising from use of the service.

10. Changes

We may update these terms; continued use after changes constitutes acceptance. Material changes will be announced in-app.

11. Governing law and disputes

These terms, and any dispute arising out of them or out of your use of Simply Streamers, are governed by the laws of the State of Texas, without regard to its conflict of law rules. You and Overclock Software LLC agree that any such dispute will be brought exclusively in the state or federal courts located in Austin, Texas, and each of us consents to the personal jurisdiction of those courts.

Nothing in this section takes away a right you have under the consumer protection laws of the place you live. If any part of these terms is found to be unenforceable, the rest of them stay in effect.
